The short version above is a convenience, not a substitute. The full terms below are what govern your use of this website and our facility.

Acceptance of these terms

These Terms & Conditions are an agreement between you and Vine Yard Fitness. By using this website, submitting the contact form, buying a membership or day pass, or entering our facility, you agree to them.

If you do not agree, please do not use the website or the facility.

These terms work alongside our Privacy Policy, Refund & Cancellation Policy, Fulfillment Policy, and Club Rules & Member Conduct Policy, which are part of this agreement.

Who we are

Vine Yard Fitness operates this website and the fitness facility at 971 Lehigh Avenue, Union, NJ 07083.

In these terms, "we," "us," and "our" mean Vine Yard Fitness. "You" means anyone who uses this website, buys from us, or trains at our facility.

Using this website

This website exists to describe the gym, answer questions, and send you to our signup portal. You may use it for those purposes and for your own personal, non-commercial use.

You agree not to:

• Use the site in a way that damages it, overloads it, or interferes with anyone else's use of it
• Attempt to gain access to areas of the site, our systems, or our accounts that are not open to you
• Submit false information, impersonate somebody else, or use the contact form to send unsolicited advertising
• Scrape, copy, or republish our photographs, copy, or design without written permission

We aim to keep the site accurate and available, but we do not promise it will always be online, error-free, or up to date. Prices, membership tiers, hours, amenities, and availability shown here can change, and details described as "coming soon" are plans rather than commitments.

Memberships and purchases

Memberships and day passes are not sold on this website. Every "Join" button takes you to our signup portal hosted by Gym Insight, our membership management provider, where you complete your purchase.

When you sign up, you enter into a membership agreement presented to you by Gym Insight at checkout. That agreement, together with these terms, governs your membership. Where the membership agreement you accept at signup says something different from these terms about billing or cancellation, the membership agreement controls.

Your membership is personal to you. It cannot be shared, lent, transferred, or sold, and your access credentials are yours alone to use.

We may decline or cancel a membership application, including where a purchase appears fraudulent or where a price has been listed in error.

Pricing, billing, and recurring payments

The following reflects what is stated elsewhere on this site:

• Memberships are month-to-month with no contract.
• Monthly memberships bill on a recurring basis until cancelled. By signing up you authorize Gym Insight to charge your payment method on that recurring schedule.
• For members joining before the gym opens, billing begins at our official opening, not on the day you sign up.
• The Founders rate holds for as long as your membership stays active and continuously paid. It is not a lifetime rate. Cancelling ends it, and rejoining later means joining at whatever rate is available at that time.
• The Founders rate is limited to the first 100 members. Once claimed, it is no longer offered.
• A One-Day Pass is a single visit and is non-refundable.
• There is no enrollment, initiation, registration, key-fob, or annual maintenance fee.

Payment methods, billing dates, receipts, and failed-payment handling are administered by Gym Insight under the agreement you accept at signup. Update your payment details in the Gym Insight member app.

Prices shown on this site are in US dollars and exclude any applicable taxes.

Signup fees

We do not charge an enrollment, initiation, registration, key-fob, or annual maintenance fee. No fee of that kind is ever charged unless it is clearly disclosed to you and accepted by you at signup.

Recurring billing and failed payments

By enrolling you authorize recurring monthly charges to the payment method held in Gym Insight, until your cancellation takes effect. A declined payment may result in temporary suspension of your access until the account is brought current.

We do not impose a separate late or declined-payment fee unless that fee was clearly disclosed to you and accepted before it was charged.

Cancelling your membership

Memberships are month-to-month and can be cancelled at any time, with no notice period. How to cancel, when the cancellation takes effect, your statutory rights under New Jersey law, and what happens to amounts already charged are all set out in the Refund & Cancellation Policy.

Cancelling ends any promotional rate attached to your membership, including the Founders rate.

Freezing your membership

You may request one freeze of up to 90 days in a rolling twelve-month period, for documented medical reasons, military deployment, or extended travel. There is no freeze fee.

While a freeze is approved and running, monthly dues and facility access are both paused. Your membership resumes automatically when the freeze ends, unless it has been lawfully cancelled before then.

An approved freeze preserves your Founders rate. A freeze is not a cancellation, so the rate survives it — this is the one way to step away for a while without losing it.

Adults only

Vine Yard Fitness is an adults-only facility for members 18 and over. We do not offer youth memberships, and minors may not train at or be brought into the facility.

This website is not directed to children. You must be 18 or over to buy a membership or day pass, or to submit the contact form.

Health and fitness acknowledgment

By using the facility you confirm that you are in good enough health to exercise, and that you have no medical condition that would make training unsafe for you.

We are not a medical provider. Nothing on this website, and nothing said by our staff or trainers, is medical advice, diagnosis, or treatment. Consult a physician before starting any exercise program, particularly if you have a heart condition, an injury, are pregnant, are taking medication, or have been inactive for some time.

Stop training and seek medical attention if you feel faint, short of breath, or unwell. Tell us about any injury or medical event that happens at the facility as soon as you are able.

Individual results vary. We make no promise of any particular fitness, weight, health, or performance outcome.

Assumption of risk

Strength training, conditioning, and the use of gym equipment carry an inherent risk of injury, including serious injury. That risk cannot be designed away, and it exists even when equipment is well maintained and used correctly.

You understand and voluntarily accept those risks, including risks arising from your own physical condition, from your use or misuse of equipment, and from the conduct of other members. You use the facility, the equipment, and any training service at your own risk.

Facility use and member conduct

The facility is open 24 hours a day and is often unstaffed. That access depends on members looking after the space and each other. The house rules in full — access and security, equipment, attire, photography, guests, storage, recovery amenities, and how violations are handled — are set out in our Club Rules & Member Conduct Policy, which forms part of these terms. The essentials:

• Enter using your own QR code, and never let anyone else in on it
• Use equipment as intended, and stop if you are unsure how a machine works
• Collars on loaded bars, weights returned to the rack, benches and machines wiped down after use
• Share equipment reasonably when the floor is busy
• Wear appropriate athletic clothing and clean, closed-toe training shoes
• Treat other members, staff, and trainers with respect; harassment, intimidation, threats, and discrimination are not tolerated
• Report damaged or unsafe equipment to us rather than working around it
• Keep out of the facility if you are unwell or under the influence of alcohol or drugs
• Follow any posted rules, signage, and reasonable staff instruction

Performance-enhancing drugs, weapons, smoking and vaping, and outside alcohol are not permitted anywhere on the premises.

We do not offer complimentary guest access. A non-member must buy a One-Day Pass, or other authorized access, before entering. You may not admit a guest on your own QR code.

Doors, gates, and access points must not be propped open or shared. Because access runs on individual QR codes, letting someone in on yours puts every other member at risk, and we treat it as a serious breach of these terms.

Personal training and other services

Personal training and small group training are offered at the facility and are arranged by inquiry rather than bought on this website. Sessions are booked directly with us or with your trainer.

Training services are separate from your membership: cancelling one does not automatically cancel the other, and a training package does not include facility access on its own.

Sessions may be bought individually or in packages, according to your trainer's published offering.

A session may be cancelled or rescheduled at no loss when you give at least 24 hours' notice. A cancellation with less than 24 hours' notice, or a no-show, may forfeit that session. If your trainer cancels, the session is rescheduled or credited.

Unused sessions are not transferable and are not refundable, except where the law requires it or where we or the trainer cannot provide the service you bought.

Only trainers authorized by Vine Yard Fitness may coach or instruct for payment on the premises.

Personal property

Bring only what you need. We are not responsible for personal property that is lost, stolen, or damaged at the facility or in the parking area, however that happens.

Suspension or termination of access

We may suspend or end your membership and your access to the facility and this website for nonpayment, fraud, unauthorized sharing of access, violence, harassment, serious safety violations, deliberate property damage, repeated rule violations, or any other material breach of these terms.

Where circumstances allow, we will tell you first and give you a chance to put it right. Conduct that puts anyone's safety at risk may result in immediate removal without notice.

If we end your membership for a reason other than your breach of these terms, any refund due is handled under the Refund & Cancellation Policy.

Intellectual property

The Vine Yard Fitness name, emblem, logo, and slogan, and the photography, video, copy, and design of this website, belong to Vine Yard Fitness or are used with permission. They are protected by copyright and trade mark law.

You may view, share, and link to our pages. You may not copy, reproduce, modify, or use our branding or content commercially without our written permission.

If you send us feedback, suggestions, or a review, we may use it to improve and promote the gym without owing you payment. Tell us if you would rather we did not.

Third-party services and links

This site relies on and links to services run by other companies, including Gym Insight for signup, billing, and 24/7 QR access, the Apple App Store and Google Play for the member app, Google Maps for the map on our Visit section, Google Fonts for typefaces, and Instagram for our social profile.

Those services operate under their own terms and privacy policies. We do not control them and are not responsible for their content, availability, or how they handle your information. Our Privacy Policy explains which of them receive your data.

Changes to services, pricing, and these terms

We may change the facility, its equipment, its amenities, its hours, the services we offer, and our prices as the business develops.

We may also update these terms. The effective date at the top of this page shows when they were last revised, and the current version is always the one published here. Continuing to use the website or the facility after a change means you accept the revised terms.

A change in membership pricing does not affect a rate you have already locked in, for as long as that membership stays active and continuously paid.

Where a change materially affects active members, we will let them know at the email address on file.

Disclaimers

This website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the website will be uninterrupted or error-free, that defects will be corrected, or that the site is free of harmful components.

Limitation of liability

To the fullest extent permitted by law, Vine Yard Fitness and its owners, employees, and trainers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of this website, the facility, or our services.

To the fullest extent permitted by law, our total liability for any claim relating to this website or your membership is limited to the amount you paid us in the twelve months before the claim arose.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our own negligence, or for fraud.

Indemnity

You agree to indemnify Vine Yard Fitness against claims, losses, and reasonable legal costs arising from your breach of these terms, your misuse of the facility or the website, or your violation of the law or of someone else's rights.

Governing law

These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute arising out of them will be brought in the state or federal courts located in Union County, New Jersey, and you and we each consent to the jurisdiction of those courts.

Nothing in these terms waives any consumer right or remedy that cannot lawfully be waived.

General

If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing a term on one occasion does not waive it. You may not transfer your rights under these terms; we may transfer ours if the business is sold or reorganized.

These terms, with the policies they reference and the membership agreement you accept at signup, are the entire agreement between you and us about their subject matter.
